What Is the Lemon Law in California?

The Lemon Law, also known as the Song Beverly Consumer Warranty Act, is a statute that provides legal protection to consumers who purchase or lease a vehicle with a severe mechanical defect. This covers both new and used cars that are still under warranty.

The law also applies to most vehicles purchased or leased in California, including cars, trucks, SUVs, motorcycles, and RVs.

 

What Qualifies as a Lemon?

To qualify as a lemon under the California lemon law, your vehicle must meet certain criteria:

  1. Substantial defect – The defect must substantially impair your vehicle’s use, value, or safety. This can include issues with the engine, electrical system, transmission, brakes, steering, or design. 
  2. Reasonable number of repair attempts – The manufacturer or authorized dealership must have made a reasonable number of repair attempts to fix the defect. In most cases, this means at least four repair attempts for the same defect or two repair attempts for a significant safety defect. 
  3. Time or mileage limit – California’s lemon law coverage applies within the first 18 months or 18,000 of ownership, whichever comes first.
